Logistics at Beginning of a Divorce:

During the beginning of a divorce, we advise our clients, at times, to take some of the following logistical precautions:

1) Set up a Separate Bank Account: Please make sure that you have a separate bank account with at least one half (1/2) of the marital cash. You never know what the other party is going to do and you do not want your spouse cutting you off financially.

2) Set up Separate Credit Cards and Remove your Spouse from Credit Cards where you Have Liability: We have seen time and time again that the other spouse will run up the charges on the credit card to "spite" the other party and for which the other party would be liable for under community property law. Yes, the Joint Preliminary Injunction (aka JPI) will enjoin them from doing this once the other party is served with the JPI, but be prepared before the the JPI is served.

3) Get a Separate Residence: If the situation justifies as where there is physical abuse, it becomes iimperative to get a separate residence or move in with a friend/family immediately. Your physical safety is paramount. Many clients have also found that even where there is no physical abuse, establishing a separate residence provides the much needed space to have mental clarity to get them through this difficult process.

4) Change all of your Passwords: Please change all of your passwords for all of your bank accounts, credit cards, emails, etc. You must assume that your spouse knows all of your passwords and that both your case and your finances may be compromised.

5) If You Still Reside with Your Spouse, Do Not Use Your Home Computer: A follow-up to the above item is that if you still reside with your spouse, you must assume that your spouse has a keyboard tracker program installed on your home computer, and therefore will be able to get all of your passwords to your emails, bank accounts, credit cards, etc. Therefore just changing the passwords once will not solve the problem. Any access to something that requires a password should be done on a computer outside of the home where you reside with your spouse.
