Failure to Pay Child Support:

If a party is required to pay child support as part of that party’s Divorce Decree, his or her failure to pay child support would constitute contempt – a violation of a court order.  Contempt is punishable by jail time and sanctions, most notably a mandatory ten percent (10%) penalty PER YEAR as well as interest and reasonable attorneys’ fees.  The District Attorneys’ Office also has a division dedicated to recovering child support, which is obviously more affordable, but less expedient option for those with patience in obtaining a recovery.

What most people do not realize is that once child support accrues, you cannot modify it.  What that means is that if your financial circumstances change (say you lose your job), you need to have your lawyer immediately file a motion to change your child support, because the child support amount does not automatically change.
