Annulment is a legal mechanism by which the courts treat marriage as “void,” meaning to treat the marriage as if it never happened.  Why get an annulment versus a divorce?  There may exist religious constraints such as the Roman Catholic Church often requires an annulment in order for someone to remarry but mostly it is just a matter of preference of having a judicial declaration that the parties were never married.  Pursuant to NRS § 125.300, an annulment may be granted on the following grounds:

1)        Lack of Consent of Parent or Guardian for the marriage of a minor. NRS § 125.320.
2)        Want of Understanding.  NRS § 125.330.  This is the grounds on which Britney Spears annulled her marriage to her childhood sweetheart, Jason Allen Alexander.
3)        If the consent to the marriage was obtained by fraud.  NRS § 125.340.
